Denver Truck Accident Lawyer

Denver Truck Accident Lawyer - Luke PuszynskiTruck accidents are typically more dangerous and can cause more catastrophic injuries than a regular car accident. And, unfortunately, the majority of those injured or killed in a truck accident are the occupants of the other vehicle. Because there are so many commercial trucks our Colorado highways, it is inevitable that truck accidents are bound to occur. Contact Luke your Denver Truck Accident Lawyer to receive a Free Case Evaluation.

There are many reasons why so many truck accidents occur.  Some of the more common reasons are:
  • lack of sleep
  • equipment failure
  • weather conditions
  • distracted driving
  • driving under the influence of drugs or alcohol
  • lack of proper driving and safety training

Additionally, it is not uncommon for companies to fail to properly vet a potential driver’s driving record and miss potential red flags that could be indicative of future negligent behavior.

Even when these high-risk drivers are involved in numerous situations that prove that they are incapable of properly and safely operating a commercial truck, many companies are reluctant to terminate these risky drivers or even to properly discipline them.

And ultimately these high-risk drivers continue operating large commercial trucks on our Colorado roads and continue making mistakes, which could eventually lead to injuries or even death.

Commercial truck operators and the companies that employ them have to follow certain rules and procedures to ensure the safety of others on the road.  Often, these rules are disregarded by both the operator and the company.

Here, at the Law Practice of Luke Puszynski, LLC, your Denver truck accident lawyer we specialize in personal injury and negligence law, with truck accidents being one of our main practice areas.

We will make sure that the negligent operator and his employer followed the proper rules and procedures and, if they DID NOT, we will make sure that they are held responsible for any reckless or negligent actions or in-actions.

We will hold the reckless or negligent parties accountable for their dangerous actions, which resulted in a terrible injury or even wrongful death.

Damages You Can Recover

Each case varies in the amount that a person can recover for their claim. Keep in mind that Colorado law ONLY allows monetary compensation for personal injury claims. There is no other way for an injured person to be fairly compensated under the law.  You cannot force the at-fault party to become a personal attendant to the injured person until recovery.

Under Colorado law, a person injured in a truck accident is allowed to recover any of the following applicable damages:

  • past and future medical expenses
  • past and future wage loss
  • pain and suffering
  • mental stress
  • inconvenience
  • impairment to the quality of life
  • physical impairment
  • physical disfigurement

Each of these damages has to be given an appropriate monetary value of compensation to equal the harm caused.

Unfortunately, the only damages that can be easily calculated are the past and future medical expenses and wage loss because there is billing for each medical provider and a monetary amount for work time lost.

The other category of damages are harder to quantify but experienced litigation attorneys have helpful ways of presenting these injuries to a jury and guiding the jury to a reasonable amount for each harm.

The only way that justice can be served under Colorado law is for all of the harms caused to you to be equally balanced by a reasonable monetary amount of compensation.

Only then will the balance of justice will be fully restored.

Let Luke utilize his extensive experience in settling and litigating truck accident cases to help you recover the appropriate amount for you for all of your harms.
